The Virginia Supreme Court has upheld a federal felony spamming conviction against Jeremy Jaynes, a North Carolina spammer who bombarded people with millions of crappy messages in 2003.
Jaynes invoked protection under the Constitution’s first amendment rights to “annonymous free speech,” but the strategy failed–albeit by a narrow 4-3 vote.

The various judicial fates dealt to Michael Vick for animal abuse and Lindsay Lohan and Nicole Richie for drunk driving have prompted all manner of outcry about differential enforcement and inconsistent treatment.
